Moratorium notice and public notice of proposal to prepare a draft water resource (Cape York) plan and availability of statement of proposals

Purpose and reasons

The Queensland Government has started the process to develop the first ever water resource plan for the remote and unique Cape York region of far north Queensland. A water planning process is the most effective way of managing water resources to achieve a sustainable balance between present and future  needs.

Section 38(1) of the Water Act 2000 provides for the Minister of Natural Resources and Mines to prepare a water resource plan for any part of Queensland to advance the sustainable management of water.

Notice is given under section 40 of the Water Act 2000, that the Minister for Natural Resources and Mines proposes to prepare a draft Water Resource (Cape York) Plan and has made available a Statement of Proposals.

Moratorium notice

A moratorium notice for the Cape York water resource plan area is made under section 26 of the Water Act 2000 and takes effect on and from 6 May 2016. The moratorium notice can be viewed at the Department of Natural Resources and Mines' website www.dnrm.qld.gov.au.

Plan area

The Cape York water resource plan area is identified in the map shown in this Notice which is indicative only. The plan area and more detail on the location of the area boundaries are held in digital electronic form by the department and may be inspected at the department's office at 28 Peters Street,  Mareeba,  Queensland 4880.

Water to which the plan is intended to apply

Water to which the plan applies:

  1. water in each watercourse, lake or spring    
  2. underground water that is not underground water managed under the Water Resources (Great Artesian Basin) Plan 2006.    

Statement of Proposals

A Statement of Proposals (PDF, 1.2MB) has been prepared in accordance with section 39 of the Water Act 2000 to address water allocation and sustainable management issues in the Cape York planarea.

Inspection of Statement of Proposals

The Statement of  Proposals can be viewed or downloaded from the department's website. Alternatively it may be inspected, or obtained free of charge, by contacting the department's office in Mareeba on 1800 697 805.

The public notice of proposal to prepare a draft Water Resource (Cape York) Planand the availability of Statement of Proposals, as required under section 40 of the Water  Act 2000, is available on the department's website at www.dnrm.qld.gov.au, the Mareeba office or from the following local government authorities:

Submissions

Anyone may make a submission about the Statement of Proposals. Submissions must:

  • be in writing and signed by each person who made the submission    
  • state the name and address of each person who made the submission    
  • state the grounds of the submission and the facts and circumstances relied on in support of the grounds    
  • be received by the person stated in Clause 8 of this Notice on or before 5pm on 29 July 2016.    

Email and online submissions will be accepted.

Submissions should identify information that is considered confidential. The department will endeavour to maintain the confidentiality of information that is identified in this way, however submissions are subject to the Right to Information Act 2009 and information may be required to be released upon requests made under this Act. Furthermore, other legal obligations, such as the processes of the courts or natural justice may also override confidentiality.
